Scheduling Policies

I at BHH Understand life happens! If you need to cancel or reschedule your health and wellness nurse session, email or text as soon as you know! Please review our policy below:

 

Cancellations: To receive a full refund, cancellations must be made at least 12 hours prior to your scheduled session. Cancellations made less than 12 hours in advance will not be eligible for a refund, except in extenuating circumstances.

 

Rescheduling: You may reschedule your session without penalty if done at least 12 hours before your scheduled time. Rescheduling within 12 hours of the session may incur a fee of 50% of the session cost, except in extenuating circumstances.

 

No Shows: If you do not attend your scheduled session and have not provided at least 12 hours' notice, the session fee will be non-refundable, except in extenuating circumstances.

 

Refunds: Refunds for eligible cancellations will be processed within 5-7 business days.

Terms and Conditions

Introduction

These terms and conditions (the “Terms”) govern the use of the Blue Heron Holistic Inc. (aka: “Blue Heron Holistic” or “BHH”) website (the “Site”) by all individuals (“You” or “Your”). As a term within these Terms, “Content” refers to content such as text, images, or other information that can be posted, uploaded, linked to or otherwise made available by You, regardless of the form of that content.

I. Acknowledgment

These Terms govern the use of the Site and the agreement that operates between You and BHH. These Terms set out the rights and obligations of all users regarding the use of the Site.

Your access to and use of the Site is conditioned on Your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Site.

 

BY ACCESSING OR USING THE SITE YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DISAGREE WITH ANY PART OF THESE TERMS, THEN YOU MAY AND SHOULD NOT ACCESS AND USE THE SITE.

You represent that You are over the age of 18. BHH does not permit those under 18 to use the Site.

YOUR ACCESS TO AND USE OF THE SITE IS ALSO CONDITIONED ON YOUR ACCEPTANCE OF AND COMPLIANCE WITH BHH’S PRIVACY POLICY. BHH’s Privacy Policy describes policies and procedures on the collection, use, and disclosure of Your personal information when You use the Site and tells You about Your privacy rights and how the law protects You. PLEASE READ BHH’S PRIVACY POLICY CAREFULLY BEFORE USING THE SITE.

II. Termination

 

BHH may terminate or suspend Your account (if applicable) or access to the Site immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms. Upon termination, Your right to use the Site may cease immediately. If You wish to terminate Your account (if applicable), You may simply discontinue using the Site.

 

III. “AS IS” and “AS AVAILABLE” Disclaimer

 

The Site is provided to You “AS IS” and “AS AVAILABLE” and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, BHH, on its own behalf and on behalf of its affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Site, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice. Without limitation to the foregoing, BHH provides no warranty or undertaking, and makes no representation of any kind that the Site will meet Your requirements, achieve any intended results, be compatible or work with any other software, applications, systems or services, operate without interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected.

Without limiting the foregoing, BHH makes no representation or warranty of any kind, express or implied: (a) as to the operation or availability of the Site, or the information, content, and materials or products included thereon; (b) that the Site will be uninterrupted or error-free; (c) as to the accuracy, reliability, or currency of any information or Content provided through the Site; or (d) that the Site, its servers, the Content, or e-mails sent from or on behalf of BHH are free of viruses, scripts, trojan horses, worms, malware, timebombs or other harmful components.

Some jurisdictions do not allow the exclusion of certain types of warranties or limitations on applicable statutory rights of a consumer, so some or all of the above exclusions and limitations may not apply to You. But in such a case the exclusions and limitations set forth in this section shall be applied to the greatest extent enforceable under applicable law.

 

IV. Correction of Errors and Inaccuracies; Limitations on Quantity; Risk of Loss

The information on the Site may contain typographical errors or inaccuracies and may not be complete or current. BHH therefore reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice (including after You have registered for the Site and/or for BHH services). Please note that such errors, inaccuracies, or omissions may relate to Your ability to use the Site or any BHH service. BHH apologizes for any inconvenience this may cause You.

 

V. Content

Your Right to Post Content

The Site allows You to post Content. You are responsible for the Content that You post to the Site, including its legality, reliability, and appropriateness.

By posting Content to the Site, You grant BHH the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through the Site. You retain any and all of Your rights to any Content You submit, post or display on or through the Site and You are responsible for protecting those rights. You agree that this license includes the right for BHH to make Your Content available to other users of the Site, who may also use Your Content subject to these Terms.

You represent and warrant that: (a) the Content is Yours (You own it) or You have the right to use it and grant BHH the rights and license as provided in these Terms; and (b) the posting of Your Content on or through the Site does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person.

Content Restrictions

BHH is not responsible for the Content of the Site’s users. You expressly understand and agree that You are solely responsible for the Content and for all activity that occurs under Your account (if applicable), whether done so by You or any third person using Your account (if applicable).

You may not transmit any Content that is unlawful, offensive, upsetting, intended to disgust, threatening, libelous, defamatory, obscene or otherwise objectionable. Examples of such objectionable Content include, but are not limited to, the following:

  • Unlawful or promoting unlawful activity.

  • Defamatory, discriminatory, or mean-spirited content, including references or commentary about religion, race, sexual orientation, gender, national/ethnic origin, or other targeted groups.

  • Spam, machine – or randomly – generated, constituting unauthorized or unsolicited advertising, chain letters, any other form of unauthorized solicitation, or any form of lottery or gambling.

  • Containing or installing any viruses, worms, malware, trojan horses, or other content that is designed or intended to disrupt, damage, or limit the functioning of any software, hardware or telecommunications equipment or to damage or obtain unauthorized access to any data or other information of a third person.

  • Infringing on any proprietary rights of any party, including patent, trademark, trade secret, copyright, right of publicity or other rights.

  • Impersonating any person or entity including BHH and its employees or representatives.

  • Violating the privacy of any third person.

  • False information and features.

 

BHH reserves the right, but not the obligation, to, in its sole discretion, determine whether or not any Content is appropriate and complies with these Terms, refuse or remove the Content. BHH further reserves the right to make formatting and edits and change the manner of any Content. BHH can also limit or revoke the use of the Site if You post such objectionable Content. As BHH cannot control all Content posted by users and/or third parties on the Site, You agree to use the Site at Your own risk. You understand that by using the Site You may be exposed to content that You may find offensive, indecent, incorrect or objectionable, and You agree that under no circumstances will BHH be liable in any way for any content, including any errors or omissions in any content, or any loss or damage of any kind incurred as a result of Your use of any content.

 

VI. Accurate Information

 

You agree to provide true, accurate, current and complete information about Yourself and Your accounts (as applicable) and You agree to not misrepresent Your identity or Your account information (if applicable). You agree to keep your account information (if applicable) up to date and accurate.

 

VII. Copyright Policy

Intellectual Property Infringement

 

BHH respects the intellectual property rights of others. It is BHH’s policy to respond to any claim that Content posted on the Site infringes a copyright or other intellectual property infringement of any person.

If You are a copyright owner, or authorized on behalf of one, and You believe that the copyrighted work has been copied in a way that constitutes copyright infringement that is taking place through the Site, You must submit Your notice in writing via email to Michele @ blueheronholistic . org and include in Your notice a detailed description of the alleged infringement.

You may be held accountable for damages (including costs and attorneys’ fees) for misrepresenting that any Content is infringing Your copyright.

 

VIII. Intellectual Property

The Site and its original content (excluding Content provided by You or other users), features and functionality are and will remain the exclusive property of BHH and its licensors.

The Site is protected by copyright, trademark, and other laws of both the Country and foreign countries.

BHH’s trademarks and trade dress may not be used in connection with any product or service without the prior written consent of BHH.

IX. Links to Other Websites

The Site may contain links to third-party websites or services that are not owned or controlled by BHH. BHH has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party websites or services. You further acknowledge and agree that BHH shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such websites or services.

BHH strongly advises You to read the terms and conditions and privacy policies of any third-party websites or services that You visit.

 

X. Governing Law

 

These Terms and all other aspects of Your access and/or use of the Site shall be governed by and construed in accordance with the laws of the United States and, to the extent applicable, the laws of the State of California, without regard to its conflict of laws rules. Your use of the Site may also be subject to other local, state, national, or international laws.

 

XI. Limitation of Liability

 

Notwithstanding any damages that You might incur, the entire liability of BHH under any provision of these Terms and Your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by You through the Site or for services of BHH or 100 USD if You haven’t purchased anything through the Site or for services of BHH.

To the maximum extent permitted by applicable law, in no event shall the BHH be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Site, third-party software and/or third-party hardware used with the Site, or otherwise in connection with any provision of these Terms), even if BHH has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.

Some states do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, which means that some of the above limitations may not apply. In these states, each party’s liability will be limited to the greatest extent permitted by law.

 

XII. Indemnification

 

You agree to indemnify and hold harmless BHH from and against any and all claims, losses, expenses, demands or liabilities, including attorneys’ fees and costs, incurred by BHH in connection with any claim by a third party (including any intellectual property claim) arising out of: (a) materials and Content You submit to, post to, or transmit through the Site; or (b) Your use of the Site in violation of these Terms, or in violation of any applicable law. You further agree that You will cooperate fully in the defense of any such claims.

 

XIII. Dispute Resolution

If You have any concern or dispute about the Site or the services of BHH, You agree to first try to resolve the dispute informally by contacting BHH. You agree that You will notify BHH in writing of any claim or dispute concerning or relating to the Site and the information or services provided through it, and give BHH a reasonable period of time to address it BEFORE bringing any arbitration or legal action, either individually, as a class member or representative, or as a private attorney general, against BHH.

 

XIV. Severability and Waiver

 

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Waiver

 

Failure by BHH to enforce any of its rights under this agreement shall not be construed as a waiver of those rights or any other rights in any way whatsoever.

 

XV. Changes to the Terms

BHH may change or update the Terms on this page from time to time. If any changes or updates are made, BHH will notify You of any changes by posting the updated Terms on this page to reflect the changes, and the "last updated" date will be changed. BHH will let You know via email and/or a prominent notice on the Site, prior to the change becoming effective. You are advised to review these Terms periodically for any changes. Changes to these Terms are effective when they are posted on this page.

Introduction

This privacy policy (the “Policy” or the “Privacy Policy”) applies to the processing of personal data by Blue Heron Holistic Inc. (aka: “Blue Heron Holistic” or “BHH”). The Privacy Policy explains BHH’s data privacy practices in regard to the processing of personal data of individuals (“You” or “Your”) who visit BHH’s website (the “Site”), and use or access the services through the Site (the “Services”) and/or as otherwise described in the Policy. BHH cares about You and Your privacy. Blue Heron Holistic is committed to maintaining the trust and confidence of Site visitors, those inquiring about Services, and You. BHH designed the Privacy Policy on this page in order to inform You of the way information about Site visitors, leads, and You is collected and utilized.

You acknowledge that this Privacy Policy is part of BHH’s Sites Terms and Condition, and by accessing, using, or interacting with Blue Heron Holistic via the Site or any other means, You agree to be bound by all of its Terms and Condition, including the terms of this Privacy Policy. I. Collecting and Using Your Personally Identifiable Information

Types of Data Collected: In order to better provide You with the Service, BHH may collect two types of information about users of the Site: Personally Identifiable Information and Non-Personally Identifiable Information. BHH’s primary goal in collecting information from You is to provide You with a smooth, efficient, and customized experience while using the Site.

 

Personally Identifiable Information: This refers to information that lets BHH know the specifics of who You are. While using the Site and/or the Services, BHH may ask You to provide certain Personally Identifiable Information that can be used to contact or identify You. IV. Security of Your Personally Identifiable Information

The security of Your Personally Identifiable Information is important to BHH. Blue Heron Holistic takes precautions to protect Your information. When You submit sensitive information via the Site, BHH takes steps to protect it both online and offline. Notwithstanding this, no method of transmission over the Internet, or method of electronic storage is 100% secure. While BHH strives to use commercially acceptable means to protect Your Personally Identifiable Information, BHH cannot guarantee its absolute security.

V. Manner of Collecting Your Data and How It is Used

BHH does not collect any Personally Identifiable Information about You unless You voluntarily provide it to BHH.

BHH does not knowingly collect, use, sell or share the personal information of children under the age of 16.

CCPA Privacy: This Privacy Policy section for California residents supplements the information contained in the Privacy Policy and it applies solely to all visitors, users, and others who reside in the State of California.

Categories of Personal Information Collected

BHH may collect information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or device. The following is a list of categories of Personally Identifiable Information which BHH may collect or may have been collected from California residents within the last twelve (12) months.

Please note that the categories and examples provided in the list below are those defined in the CCPA. This does not mean that all examples of that category of personal information were in fact collected by BHH, but reflects BHH’s good faith belief to the best of BHH’s knowledge that some of that information from the applicable category may be and may have been collected. For example, certain categories of Personally Identifiable Information would only be collected if You provided such personal information directly to BHH.

  • Category A: Identifiers. Examples: A real name, alias, postal address, unique personal identifier, online identifier, Internet Protocol address, email address, account name, driver's license number, passport number, or other similar identifiers. Collected: Yes.

  • Category B: Personal information categories listed in the California Customer Records statute (Cal. Civ. Code § 1798.80(e)). Examples: A name, signature, Social Security number, physical characteristics or description, address, telephone number, passport number, driver's license or state identification card number, insurance policy number, education, employment, employment history, bank account number, credit card number, debit card number, or any other financial information, medical information, or health insurance information. Some personal information included in this category may overlap with other categories. Collected: Yes.

  • Category C: Protected classification characteristics under California or federal law. Examples: Age (40 years or older), race, color, ancestry, national origin, citizenship, religion or creed, marital status, medical condition, physical or mental disability, sex (including gender, gender identity, gender expression, pregnancy or childbirth and related medical conditions), sexual orientation, veteran or military status, genetic information (including familial genetic information). Collected: No.

  • Category D: Commercial information. Examples: Records and history of products or services purchased or considered. Collected: No.

  • Category E: Biometric information. Examples: Genetic, physiological, behavioral, and biological characteristics, or activity patterns used to extract a template or other identifier or identifying information, such as, fingerprints, faceprints, and voiceprints, iris or retina scans, keystroke, gait, or other physical patterns, and sleep, health, or exercise data. Collected: No.

  • Category F: Internet or other similar network activity. Examples: Interaction with the Service or advertisement. Collected: Yes.

  • Category G: Geolocation data. Examples: Approximate physical location. Collected: Yes.

  • Category H: Sensory data. Examples: Audio, electronic, visual, thermal, olfactory, or similar information. Collected: No.

  • Category I: Professional or employment-related information. Examples: Current or past job history or performance evaluations. Collected: No.

  • Category J: Non-public education information (per the Family Educational Rights and Privacy Act (20 U.S.C. Section 1232g, 34 C.F.R. Part 99)). Examples: Education records directly related to a student maintained by an educational institution or party acting on its behalf, such as grades, transcripts, class lists, student schedules, student identification codes, student financial information, or student disciplinary records. Collected: No.

  • Category K: Inferences drawn from other personal information. Examples: Profile reflecting a person's preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes. Collected: No.

 

Under CCPA, personal information does not include:

  • Publicly available information from government records.

  • Deidentified or aggregated consumer information.

  • Information excluded from the CCPA's scope, such as:

    • Health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the California Confidentiality of Medical Information Act (CMIA) or clinical trial data.

    • Personal Information covered by certain sector-specific privacy laws, including the Fair Credit Reporting Act (FRCA), the Gramm-Leach-Bliley Act (GLBA) or California Financial Information Privacy Act (FIPA), and the Driver's Privacy Protection Act of 1994.

 

Sources of Information

 

BHH may obtain Information from the following sources: 

  • Directly from You. For example, from information You provide.

  • Indirectly from You. For example, from observing Your activity on the Site.

  • Automatically from You. For example, through cookies BHH or BHH’s service providers set on Your device as You navigate through the Site.

  • From Service Providers. For example, from third-party service providers.

 

Use of Personally Identifiable Information for Business Purposes or Commercial Purposes

 

BHH may use or disclose Personally Identifiable Information BHH collects for "business purposes" or "commercial purposes" (as defined under the CCPA), which may include the following examples:

  • To provide and maintain the Services or the Site.

  • To contact You by email, telephone calls, SMS, or other equivalent forms of electronic communication.

  • To provide You with news, special offers and general information about other goods, services and events which BHH offer that are similar to those that You have already purchased or enquired about unless You have opted not to receive such information.

If BHH decides to collect additional categories of Personally Identifiable Information or use the Personally Identifiable information BHH collected for materially different, unrelated, or incompatible purposes BHH will update this Privacy Policy.

Disclosure of Personal Information for Business Purposes or Commercial Purposes

BHH may use or disclose and may have used or disclosed in the last twelve (12) months the following categories of personal information for business or commercial purposes:

  • Category A: Identifiers.

  • Category B: Personal information categories listed in the California Customer Records statute (Cal. Civ. Code § 1798.80(e)).

  • Category F: Internet or other similar network activity.

  • Category G: Geolocation data.

 

Please note that the categories listed above are those defined in the CCPA. This does not mean that all examples of that category of personal information were in fact disclosed, but reflects BHH’s good faith belief to the best of BHH’s knowledge that some of that information from the applicable category may be and may have been disclosed.

 

Sale of Personal Information

As defined in the CCPA, "sell" and "sale" mean selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, a consumer's personal information by the business to a third party for valuable consideration. This means that BHH may have received some kind of benefit in return for sharing personal information, but not necessarily a monetary benefit.

BHH has not sold in the last twelve (12) months any categories of Personally Identifiable Information.

 

Sale of Personal Information of Minors Under 16 Years of Age

BHH does not sell the personal information of consumers BHH actually knows are less than 16 years of age.

If You have reason to believe that a child under the age of 13 (or 16) has provided BHH with personal information, please contact BHH with sufficient detail to enable BHH to delete that information.

Access to and Control Over Your Information – Your Rights Under the CCPA

According to the California Consumer Privacy Act (CCPA) of 2018, You are entitled to view, amend, or delete Your personal information with Blue Heron Holistic.

The CCPA provides California residents with specific rights regarding their personal information. If You are a resident of California, You have the following rights:

  • The right to notice. You have the right to be notified which categories of Personally Identifiable Information are being collected and the purposes for which the Personally Identifiable Information is being used.

  • The right to request. Under the CCPA, You have the right to request that BHH disclose information to You about BHH’s collection, use, sale, disclosure for business purposes and share of personal information. Once BHH receives and confirms Your request, BHH will disclose to You: (a)The categories of personal information BHH collected about You; (b) The categories of sources for the personal information BHH collected about You; (c) BHH’s business or commercial purpose for collecting or selling that personal information; (d) The categories of third parties with whom BHH shares that personal information; (e) The specific pieces of personal information BHH collected about You; (f) If BHH sold Your personal information or disclosed Your personal information for a business purpose, BHH will disclose to You: (i) The categories of personal information categories sold; and (ii) The categories of personal information categories disclosed.

  • The right to say no to the sale of Personally Identifiable Information (opt-out). You have the right to direct BHH to not sell Your personal information. To submit an opt-out request please contact BHH.

  • The right to delete Personally Identifiable Information. You have the right to request the deletion of Your Personally Identifiable Information, subject to certain exceptions. Once BHH receives and confirms Your request, BHH will delete Your personal information from its records, unless an exception applies.

  • The right not to be discriminated against. You have the right not to be discriminated against for exercising any of Your consumer's rights, including by: (a) Denying goods or services to You; (b) Charging different prices or rates for goods or services, including the use of discounts or other benefits or imposing penalties; (c) Providing a different level or quality of goods or services to You; and (d) Suggesting that You will receive a different price or rate for goods or services or a different level or quality of goods or services.

Blue Heron Holistic processes payments using Square via Wix; BHH does not collect or store your credit card information, this data is secured through the payment processor Square.

Blue Heron Holistic utilizes Jotform for your intake paperwork, this information is then stored and password protected internally.

Blue Heron Holistic provides virtual services via traditional phone calls or Zoom video calls.

The third-party service providers BHH uses may have access to Your Personally Identifiable Information. These third-party service providers collect, store, use, process and transfer information about Your activity in accordance with their privacy policies.

Blue Heron Holistic doesn't believe in using code to manipulate You into returning to the Site, therefore BHH does not currently use social media pixels. Should this change, this Privacy Policy will be updated to reflect the changes to these Policies and the "last updated" date will be changed.

 

Currently Blue Heron Holistic works to optimize this Site's SEO and plans to use Google or other search engine analytics and advertisement options.
